ONLINE STORE REGULATIONS

("Regulations")


  • INTRODUCTORY INFORMATION

    1. The online store operating at www.bebeconcept.pl ("Store") is operated by Piotr Chęć who runs the business under the name "BEBE CONCEPT PIOTR CHĘĆ", Leszczyńska 6/9 street, 00 - 339 Warsaw, Polish tax identification number (NIP): 7171673293, REGON: 381969390 ("Entrepreneur"). 
    2. The Administrator of the Personal Data is Piotr Chęć conducting business under the name "BEBE CONCEPT PIOTR CHĘĆ", Leszczyńska 6/9 street, 00 - 339 Warszawa, Polish tax identification number (NIP): 7171673293, REGON: 381969390.
    3. Regulations are addressed to each user of the Store and set out the rules for registration and use of an account at the Store, rules for electronic reservation of Goods available at the Store ("Goods") and rules of placing orders at the Store and conclusion of sales agreements.
    4. Each user of the Store can access the Regulations at any time, by "clicking" the link "Regulations" located on the page of the Store, which after clicking will be redirected to a subpage, where is the full content of the Regulations.
    5. User can contact the Entrepreneur running the Store in any of the following ways:
      1. through the contact form on the website of the online store;
      2. by telephone at +48 511 687 519;
      3. via electronic mail, at the e - mail address: kontakt@bebeconcept.pl.
    6. The Goods in the Store are specified in detail. The website contains information about the properties of the Goods, in particular, about its price, material from which it is made, etc.
    7. Information about the Goods, referred to in paragraph 1.6 above, constitute an invitation to submit an offer to conclude a contract of sale within the meaning of Article 71 of the Civil Code, in accordance with the terms of the Regulations.

  • RULES OF USING THE STORE

    1. The Entrepreneur enables through the Store selection of Goods and the conclusion of sales contracts concerning them, as well as provision of other services referred to in the Regulations.
    2. A contract of sale of an Good is concluded between the Entrepreneur and a user of the Store ("Customer").
    3. A prerequisite for the use of the Store is familiarization with the Regulations. Confirmation of this condition is required each time before the conclusion of a contract of sale of a Goods.
    4. Before concluding a contract of sale, the Customer shall fill in a form containing the necessary data to fulfill the obligations of the Entrepreneur in connection with the contract of sale of a Goods ("Form"). Information included in the Form should be truthful, up-to-date and accurate. The Entrepreneur reserves the right to refuse to process an order if the data provided is so inaccurate that it prevents the execution of the order, in particular, prevents proper delivery. Before refusing to process an order the Entrepreneur will try to contact the Customer to determine the data to the extent necessary to complete the order.
    5. Persons registering in the Store and entering into contracts of sale of a Goods provide their personal data, which the Entrepreneur processes on the principles indicated in the Privacy Policy. The Entrepreneur takes all possible and legally required technical and organizational measures to protect Customers' personal data, in particular, to prevent acquisition and modification by unauthorized persons of data provided during the registration and conclusion of the contract of sale of Goods.

  • CONCLUSION OF A SALES CONTRACT
    1. The Store allows to place orders through the website www.bebeconcept.pl.
    2. The Store accepts orders placed online around the clock, seven days a week. Orders placed on holidays will be processed within two working days after the day of placing the order.
    3. To conclude a contract of sale of Goods the Customer does not have to set up an account with the Store, the so-called shopping without setting up an account.
    4. When ordering a Goods the Customer makes a choice, in a manner appropriate for the given Goods, specifying in particular the size, color, number of pieces, and if necessary, also giving other specific information necessary for the proper implementation of the Entrepreneur's obligation under the contract of sale.
    5. The condition of placing an order is filling in the Form all required data necessary for shipment or generation of a document confirming the sale of the Goods.
    6. Selection of Goods and conclusion of a contract of sale requires the following actions to be performed by the Customer:
      1. After the Customer has selected the Goods and indicated their characteristics such as quantity, size, color, click the "Add to Cart" icon.
      2. The product shall be transferred to the shopping cart which is visible in the upper right corner of the website. After selecting the "Proceed to checkout" option, if the Customer has not decided to set up an account in the Store, the Customer is redirected to a form containing the information necessary to complete the order, including the Customer's e-mail address, contact details, as well as the option to select the delivery method. 
      3. If the Customer wishes to use the possibility of concluding the contract of sale of the Goods via an individual account in the Store, the Customer shall select the option "log in" in the Form and will be redirected to the logging page of the Store. The Customer is able at any time to set up a new account in the Store.
      4. In the login form for an account in the Store and in the form for creating an account in the Store, the Customer should enter the data necessary to complete the transaction and dispatch the ordered Goods. 
      5. The Customer has the option of choosing one of the currently available payment methods in the section - Select payment - online payment, traditional transfer or payment on delivery.
      6. Until the moment of confirming the choice of Goods with the button "I buy and pay", the Customer has the possibility of making changes and modifications to the Goods in the order, as well as to the shipping address or invoice data. Confirmation of the order by the Customer by using the button "I buy and pay" is equivalent to acceptance of the obligation to pay the price of the Goods and the costs of their delivery, of which the Customer shall be informed directly before validation of the order and conclusion of the contract of sale of the Goods.
      7. If the Customer has chosen online payment, after making the payment, the Customer is redirected to the order confirmation page from which can continue shopping or go to the order summary.
      8. If the payment is not received by the Entrepreneur (when online payment method or traditional transfer method was chosen), the order is not considered to be properly placed, which means that the contract is not concluded and the order will not be processed.
    7. Immediately after placing an order, an e-mail confirming the order will be sent to the Customer's e-mail address given in the login data or given in the contact form, if the Customer does not have an account at the Store. In the content of this message, the Customer will receive an individualized order number, the provision of which allows to determine the status of the order.
    8. The Entrepreneur reserves the right to contact the Customer at the e-mail address provided by the Customer or by phone at the contact telephone number provided by the Customer in order to clarify any doubts, confirm the order or in any other matter related to the order and conclusion of a contract of sale of the Goods.
    9. The sales contract shall be concluded in the Polish language, with the content compliant with these Regulations and the order placed by the Customer.

  • PRICE, DELIVERY AND PICKUP, PAYMENT METHODS
    1. Prices on the Store given in Polish zloty are gross prices, including VAT.
    2. Shipping cost shall be added to the Goods price, the amount of which shall depend on the chosen form of delivery and payment.
    3. The Entrepreneur reserves the right to change prices of the Goods displayed in the Store, introduce new Goods for sale, conduct and cancel promotional campaigns at the Store's websites or introduce changes in them. However, the price given on the website at the time of placing an order is the final price, binding both for the Customer and the Entrepreneur.
    4. The cost of delivery is specified in the price list, available at www.bebeconcept.pl/pages/dostawa-i-platnosci, which includes a list of available methods of delivery and the cost of each of them.
    5. The Goods are delivered to the address indicated by the Customer in the order. Estimated date of delivery of the Goods is specified in the summary of the order, before the Customer confirms the order by using the "Buy and pay" button.
    6. The delivery time is 2 working days from the day following the shipment. The total and maximum order processing time should not exceed 7 working days, and in any case will not exceed 20 days from the date of conclusion of the sales contract. Processing of the order will begin at the time of crediting the Store's bank account with the amount of the sales price plus shipping costs, if the Customer chooses a form of payment on - line or traditional transfer.
    7. Delivery of Goods are carried out in Poland using the courier company chosen by the Entrepreneur, as well as abroad. 
    8. Orders exceeding the specified value are sent at the expense of the Store. Information about the currently applicable limit is always placed on the Store's website and in the "basket" tab when placing an order. Otherwise, the shipping costs of the purchased Goods shall be borne by the Customer, of which the Customer shall be informed before the order is confirmed. Each shipment of Goods shall be provided by a proof of purchase (receipt or VAT invoice), a document with the order specification and a Goods return form.
    9. The Customer shall pay the price for the Goods being the subject of the sale contract, at its choice:
      1. in cash or by credit card (if the transport company allows this option), via courier at the place of delivery (cash on delivery);
      2. by bank transfer, via electronic payment made in the payment system Quick Payment - Tpay.com & Card Payment before delivery;
      3. by bank transfer to the bank account of the Entrepreneur Bebe Concept mBank 65 1140 2004 0000 3502 7827 6719.

  • COMPLAINT OF GOODS
    1. Products offered in the store are brand new and original, the Entrepreneur is responsible for physical or legal defects of the Goods on the principles provided for in the Civil Code, in particular Article 556 and subsequent. 
    2. The Entrepreneur takes actions to ensure a fully proper functioning of the Store to the extent resulting from the current technical knowledge and agrees to remove within a reasonable time any irregularities reported by users.
    3. Any Goods purchased in the Store can be a subject of a complaint, in accordance with the provisions of the Civil Code on warranty on sale, if a defect in the Goods (including non-conformity with the contract) is found within two years from its delivery to the Customer.
    4. Complaints can be made via e-mail by sending an e - mail to the address kontakt@bebeconcept.pl, which will contain a description of the defect, as well as photos documenting the defect. If the Store is not able to determine the defect of the Goods on the basis of the sent pictures and the description of the defect, the Store may ask the Customer to take more pictures or send more detailed description of the defect, as well as request to send back the complained Goods together with the proof of purchase to the address: BEBE CONCEPT, 55 Trenów Street, 05 - 080 Laski, with the note "BEBE CONCEPT - REKLAMACJA", in order to consider the complaint. 
    5. The Customer will be informed of the manner of processing the complaint within 14 days counted from the day following receipt by the Store of an e-mail with a description of the defect and photos documenting the defect or, if the Store is unable to determine the defect of the Goods on this basis - upon receipt of the parcel containing the complained Goods. The Store shall inform the Customer about the method of settlement of the complaint via e-mail to the address from which the complaint message was sent. 
    6. If the Goods has defects, the Customer shall be entitled to the following claims under art. 556 and art. 561 of the Civil Code:
      1. submission of a declaration on withdrawal from the Contract or reduction in the price of the Goods, unless the Store immediately and without excessive inconvenience for the Customer replaces the Goods with goods free from defects or remove the defect, or;
      2. request to replace the Goods with a defect-free one or to remove the defect.
    7. In the case of not accepting the complaint, the Customer shall receive a message via e-mail to the address from which the complaint message was sent about the unjustifiedness of the complaint, and in the case where it was necessary to send back the complained Goods to the Store for investigation of the complaint, which then turned out to be unjustified, the Goods shall be sent back to the Customer together with an opinion as to the unjustifiedness of the complaint.

  • WITHDRAWAL FROM THE CONTRACT
    1. The Customer who is a consumer as defined by the law, has the right to withdraw from the contract of sale without giving any reason, on the terms described below.
    2. The right to withdraw from the contract expires after 14 days from the date when the Customer took possession of the Goods, in which a third party other than the carrier and indicated by the Customer took possession of the Goods.
    3. To exercise the right of withdrawal, the Customer must make an explicit statement of withdrawal to the Entrepreneur in one of the following ways:
      1. by sending an e-mail to the address: kontakt@bebeconcept.pl;
      2. by printing, completing and sending inside of package with returned goods a model withdrawal form available on the website of the Store at bebeconcept.pl/formularz-zwrot - but this is not an obligatory form;
    4. Each of the ways indicated in paragraph 6.3. above is equivalent and admissible, however, the recommended way of making a declaration of withdrawal is contact via e-mail to the address referred to in paragraph. 6.3. subsection 1) above.
    5. To meet the deadline for withdrawal from the contract of sale it is sufficient for the Customer to send information concerning the exercise of the Customer's right of withdrawal before the expiry of the 14-day period referred to above.
    6. The Customer shall send back the Goods which are subject to withdrawal to the following postal address: BEBE CONCEPT, 55 Trenow Street, 05 - 080 Laski, Poland, immediately, and in any case not later than 14 days from the day on which the Customer notified the Entrepreneur of withdrawal from the contract. The deadline is met if the Customer sends the Goods before the expiry of this period.
    7. The Customer shall bear the direct costs of returning the Goods.
    8. In the case of a withdrawal from the contract the Store returns to the Customer all payments received from the Customer, including the cost of delivery of Goods (with the exception of additional costs arising from the chosen by the Customer way of delivery other than the cheapest ordinary way of delivery offered by the Store), immediately, and in any case no later than 14 days from the date on which the Store was informed about the Customer's decision to exercise his right of withdrawal.
    9. Return of payments to the Customer shall be made using the same methods of payment that were used by the Customer in the conclusion of the contract of sale of the Goods, unless the Customer has explicitly agreed to a different solution. In any case, the Customer shall not incur any fees in connection with return. The Entrepreneur may withhold the return of payments until receives the Goods or until it provides the Store with proof of return, whichever occurs first.
    10. The Customer shall be liable for any diminution in the value of the Goods resulting from use of the Goods in a manner other than necessary to determine the nature, characteristics and functioning of the Goods.
    11. The provisions of this paragraph shall apply mutatis mutandis to a natural person who enters into a contract directly related to his economic activity, where the contents of contract indicate that it has not professional nature for this person, resulting in particular from the object of the economic activity conducted by said person, made available under the provisions on the Central Records and Information on Economic Activity.
    12. The right of withdrawal shall not apply to the Customer who is a consumer in relation to contracts in which the subject of the provision is the Goods supplied in a sealed package that can not be returned after opening the package for health or hygiene reasons, if the package has been opened after delivery.

  • ISSUING AN INVOICE
    1. In the case of request for invoice, the Customer shall provide the necessary data, but the provision of Tax Identification Number (NIP) for invoice should be made no later than when placing an order.
    2. The Entrepreneur is not responsible for incorrect or incomplete invoice data provided by the Customer.

  • AMICABLE SETTLEMENT OF DISPUTES

  • We inform that the Customer who is a consumer has the opportunity to use the following out-of-court methods of dealing with complaints and claims:
    1. the possibility to request an out-of-court procedure for solving consumer disputes on the basis of the Act of 23 September 2016 on out-of-court resolution of consumer disputes (Journal of Laws of 2016, item 1823), i.e. e.g. to the Provincial Inspector of the Trade Inspection in Warsaw;
    2. requesting that the case be heard by the Permanent Consumer Arbitration Court operating at the relevant Provincial Trade Inspection Inspectorate;
    3. apply to the Municipal Consumer Ombudsman for assistance in protecting consumer interests and rights. Free assistance to consumers in the protection of their rights and interests is also provided by social organizations, such as, among others, the Federation of Consumers.
    1. If the Customer purchases the Goods as a consumer, the Customer shall also be entitled to use the out-of-court method of dispute resolution and claim settlement in the form of the ODR (Online Dispute Resolution) interactive platform, in accordance with the Regulation of the European Parliament and of the Council (EU) No 524/2013 of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/EC ("ODR Regulation")
    2. The ODR platform is an interactive tool made available to European Union consumers through which they can submit a complaint (europa.eu/consumers/odr). According to Article 1 of the ODR Regulation, the objective of the ODR platform is to provide consumers with a tool facilitating the independent, impartial, transparent, effective, quick and fair out-of-court resolution of disputes between consumers and traders online in the European Union.

  • PROVISION OF SERVICES BY ELECTRONIC MEANS

  • The Entrepreneur provides the following services to users electronically:
    1. enabling the conclusion of contracts of sale of Goods in the Store on the principles described in the Regulations;
    2. allowing the creation of Customer accounts in the Store;
    3. transmission of ordered commercial information concerning Goods.
    1. The principles of withdrawal by the Customer from the contract of sale of Goods are regulated in the Regulations. At the same time the Customer is entitled at any time to request discontinuation of service by the Store services indicated in paragraph 9.1 point 2) and 9.1 point 3) above.
    2. The technical conditions for the provision of electronic services by the Store are as follows:
    1. access to the Internet;
    2. use of a web browser capable of editing hypertext documents (such as Internet Explorer, Opera, FireFox or similar);
    3. having an e-mail account;
    4. complaints concerning the services provided by the Entrepreneur by electronic means may be submitted by sending a complaint to the e-mail address: kontakt@bebeconcept.pl. A Customer's complaint should include the designation of the recipient of the service and a brief description of the complaint. The Entrepreneur shall make every effort to consider complaints as soon as possible, however, no later than 14 days from the date of receipt of a complaint by the Entrepreneur. At the Customer's choice, the Customer will be informed about the method of processing a complaint by telephone or by a message sent to the e-mail address provided by the Customer.
